Terms of Service

Welcome, and thank you for choosing Monday Call. These Terms of Service (“Terms” or “Agreement”) govern your use of the Monday Call mobile application and any related services, websites, or software (collectively, the “Service”) provided by Monday Call.
The Service is intended only for users located in the United States, and your use is governed by U.S. law. By accessing, installing, or using the Service, or by clicking “I Agree,” you are agreeing to be bound by these Terms, as well as our Privacy Policy, which is incorporated into this Agreement by reference. If you do not agree to these Terms, you may not use the Service.
We may update or modify these Terms from time to time. If we make material changes, we will notify you within the app or through other appropriate means. Your continued use of the Service after any updates means you accept the modified Terms. You should review these Terms regularly to stay informed of any changes.
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE AN AGREEMENT TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS, LIMIT CERTAIN TYPES OF LEGAL RELIEF, AND AFFECT YOUR LEGAL RIGHTS. UNLESS YOU OPT OUT, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR JURY TRIALS.

Monday Call provides a personal finance management platform accessible through our website, mobile applications, and any other tools or technologies we may develop from time to time (collectively, the “Service”). The Service is designed to help users:
Monitor and categorize spending;
Track income and recurring transactions;
Set financial goals and plan upcoming payments;
Receive insights and alerts based on financial activity.
Some features of the Service may use automated analysis or artificial intelligence to provide summaries, alerts, or suggestions. These features are intended for informational purposes only and do not constitute financial, legal, or investment advice.
The Service may also include access to content, tools, or offers provided by third parties, such as financial institutions or affiliate partners. These offerings are included for convenience and may be subject to separate terms and privacy policies. Monday Call does not endorse or guarantee any third-party products or services.
We may enhance, modify, suspend, or discontinue any aspect of the Service at our sole discretion and without prior notice, though we will make reasonable efforts to notify users of material changes when required by law. Continued use of the Service after such changes constitutes your acceptance of them.
The Service is intended solely for personal, non-commercial use. By using the Service, you agree to be bound by these Terms and any policies or documents referenced herein.

To use the Service, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater. By accessing or using the Service, you confirm that you are legally capable of entering into a binding agreement, have not been previously suspended or removed from the Service, and will use the Service in compliance with these Terms and all applicable laws and regulations.
We reserve the right to suspend or terminate your access to the Service if we determine that you no longer meet these eligibility requirements. You are solely responsible for ensuring that your use of the Service is lawful in the jurisdiction where you access it.

To access certain features of the Service, you must create an account. You agree to provide current, complete, and accurate information during registration and to update your information promptly if it changes. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you.
You may not share your credentials or allow others to access your account. If you believe your account has been compromised or accessed without authorization, you must contact us immediately at support@mondaycall.app. We reserve the right to suspend or terminate your account if we suspect any unauthorized use or violation of these Terms. Your account is personal to you and may not be transferred or assigned to another individual or entity. We may refuse, suspend, or cancel account registration at our sole discretion.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or reverse engineer any part of the Service. You agree not to use the Service for any purpose that competes with Monday Call or that violates any applicable laws, regulations, or the rights of others. You also agree not to attempt to gain unauthorized access to any part of the Service, interfere with its operation, or use it in a way that could harm us or other users. We reserve all rights not expressly granted to you in these Terms.

By connecting your financial accounts to the Service, you authorize Monday Call and our authorized data providers, such as Plaid, to access, retrieve, and process your financial information on your behalf. You grant Monday Call a limited power of attorney to act as your agent for the sole purpose of obtaining and managing this data to provide the features and functionality of the Service.
While we strive to ensure the security and privacy of your information, we do not control, verify, or guarantee the accuracy, completeness, or timeliness of the data obtained from third-party financial institutions or data providers. You acknowledge and agree that Monday Call is not responsible for any errors, omissions, or inaccuracies in such third-party data or any losses or damages resulting from its use.

Certain features of the Service may be available only through a paid subscription or one-time purchase. By subscribing, you authorize Monday Call to charge your selected payment method on a recurring basis, as applicable, until you cancel your subscription. You may cancel your subscription at any time through your account settings or by contacting us at support@mondaycall.app; however, cancellations will take effect at the end of the current billing cycle, and no refunds will be issued for any unused portion of a subscription period.
We may modify the pricing, features, or structure of paid offerings with reasonable advance notice, and continued use of the paid features after such changes will constitute your acceptance of the updated terms.

Your privacy is important to us. Our practices regarding the collection, use, sharing, and protection of your personal information are described in our [Privacy Policy], which is incorporated into these Terms by reference. By accessing or using the Service, you acknowledge and agree to the terms of our Privacy Policy, including any updates or modifications.
You also consent to the collection and use of your data as described therein,including the sharing of certain information with third-party partners when necessary to provide or improve the Service. If you do not agree with our Privacy Policy, you should not use the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service in any manner that:
Violates any applicable local, state, national, or international law or regulation;
Attempts to gain unauthorized access to, interfere with, damage, or disrupt any part of the Service, its related systems, servers, or networks;
Uses automated systems (such as bots or scrapers) to access the Service without our prior written consent;
Uploads, transmits, or distributes any viruses, worms, malware, or other content intended to disrupt or damage the functionality of the Service or another user’s experience;
Harasses, threatens, or otherwise harms any other users or third parties.
We reserve the right to suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated this section or otherwise engaged in conduct that may harm the Service, its users, or our business.

The Service may link to, integrate with, or rely on third-party services, platforms, and tools to function: such as financial data aggregators, payment processors, or external content providers. These third-party services are not owned or controlled by Monday Call and are governed by their own terms of use and privacy policies.
We may offer tools to facilitate your connection to these services (such as syncing financial accounts), but you remain solely responsible for providing any necessary credentials, managing your connections, and complying with the applicable terms of the third-party providers. Monday Call does not guarantee the availability, accuracy, or reliability of data obtained through third-party services and disclaims any liability arising from your use of or reliance on them.
Your interactions with third-party services are solely between you and the relevant third party.

To the maximum extent permitted by law, Monday Call and its affiliates, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability for all claims arising out of or relating to the Service will not exceed the greater of one hundred dollars ($100) or the total amount you paid to Monday Call for the Service in the twelve (12) months preceding the event giving rise to the claim.
You acknowledge that the Service is provided on an “as-is” and “as-available” basis, and that your use of the Service is at your sole risk. We make no warranties or guarantees regarding the accuracy, completeness, reliability, or availability of the Service or any content or data accessed through it.

You agree to defend, indemnify, and hold harmless Monday Call, its affiliates, officers, directors, employees, partners, and service providers from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use or misuse of the Service;
Your violation of these Terms or any applicable law or regulation;
Your breach of any third-party rights, including intellectual property or privacy rights.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

We may suspend or terminate your access to the Service at any time, with or without notice or cause, including if we reasonably believe you have violated these Terms or engaged in unauthorized or unlawful activity.
You may discontinue use of the Service at any time by deleting your account or uninstalling the app. Upon termination, all rights granted to you under these Terms will immediately cease, and you will no longer be permitted to access the Service.
Termination does not affect any payment obligations or rights and remedies that have accrued before termination.

A. Agreement to Arbitrate
To the fullest extent permitted by law, you and Monday Call agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (“Disputes”) exclusively through final and binding arbitration. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
B. Waiver of Jury Trial and Class Actions
By agreeing to arbitration, you waive any right to a jury trial or to participate in a class, collective, mass, or representative action. Arbitration must be conducted on an individual basis. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.
C. Scope of Arbitration
This agreement to arbitrate applies to all Disputes, regardless of legal theory, including but not limited to claims based on contract, tort, statute, fraud, misrepresentation, or any other theory, whether arising during or after your use of the Service.
D. Opt-Out
You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending an email to support@mondaycall.app with your full name and a clear statement that you wish to opt out. Opting out will not affect any other terms.
E. Location and Procedure
Unless otherwise agreed, arbitration will take place in the county of your billing address or remotely via video conference. For claims under $15,000, you may choose whether the arbitration proceeds:
based solely on documents;
through a phone or video hearing;
or by an in-person hearing as permitted by AAA rules.
F. Arbitration Costs
For claims under $15,000, Monday Call will cover all filing, administration, and arbitrator fees unless the arbitrator finds your claim to be frivolous or brought in bad faith. For claims above that amount, fees will be governed by AAA rules.
G. Exceptions to Arbitration
This Section does not apply to the following types of claims, which may be brought in court:
Individual small claims;
Requests for injunctive or equitable relief;
Intellectual property disputes (e.g., copyright, trademark, patent).
H. Severability
If any part of this arbitration section is found to be unenforceable, the rest will remain in effect, except that if the waiver of class actions is deemed unenforceable, this entire section will be void.
I. Governing Law
The Federal Arbitration Act governs the interpretation and enforcement of this Section.

We are not liable for any failure or delay in performance resulting from events beyond our reasonable control. These events may include natural disasters, power outages, internet or communication failures, strikes, labor disputes, war, terrorism, civil disturbances, pandemics, government actions, or restrictions. During such events, our obligations will be suspended for the duration of the disruption.

If you access or download the Service through the Apple App Store or any other app store, you acknowledge that these Terms are between you and Monday Call—not with the app store provider. You also acknowledge that:
The app store has no obligation to provide maintenance or support services for the Service;
The app store is not responsible for addressing any claims related to the Service or your use of it;
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as such.
You agree to comply with all applicable third-party terms of service when using the Service.

You represent you are not:
Located in a country under U.S. embargo;
Listed on any U.S. Government list of prohibited or restricted parties.

You represent and warrant that:
You are not located in a country subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country;
You are not listed on any U.S. government list of prohibited or restricted parties, including the Specially Designated Nationals (SDN) list.
You agree not to use or export the Service in violation of any U.S. or international trade laws or regulations.

If you provide feedback, suggestions, or ideas regarding the Service, you agree that Monday Call may use them freely and without restriction. You assign all rights, title, and interest in such feedback to us, and you understand that we are not obligated to provide any compensation or acknowledgment in return.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any permitted legal action must be filed in courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction and venue of those courts.

These Terms, along with our Privacy Policy, represent the complete and exclusive agreement between you and Monday Call regarding your use of the Service. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights without restriction. No waiver of any part of these Terms will be effective unless in writing and signed by an authorized representative of Monday Call. Our failure to enforce any right or provision does not constitute a waiver of that right.
